SAVANT TOURS INC. - CUSTOMER TERMS OF SERVICE

PLEASE READ THIS AGREEMENT CAREFULLY. IT SETS FORTH THE LEGALLY BINDING TERMS AND CONDITIONS FOR YOUR PARTICIPATION IN TOURS WITH SAVANT TOURS INC. BY BOOKING A TOUR, YOU ARE AGREEING TO BE BOUND BY THESE TERMS.

This Customer Terms of Service Agreement (the “Agreement”) is a legally binding contract entered into between you (“you”, “your”, or “Customer”) and Savant Tours Inc., an Ontario corporation (“Savant Tours”, “we”, “us”, or “our”). This Agreement governs your booking of, participation in, and payment for any tour, experience, or service offered by Savant Tours (each, a “Tour”).

By booking a Tour, you represent and acknowledge that you have read, understood, and agree to be bound by all terms and conditions of this Agreement. If you are booking on behalf of other participants, you guarantee that you have the authority to accept and do accept these terms on their behalf.

  1. The Services
    Savant Tours will provide the Tour as described in the official Tour description on our website or other authorized materials for the specific itinerary you have purchased. This includes the services of a tour guide and inclusions as explicitly listed. Any service not explicitly listed as an inclusion is excluded from the Tour (e.g., airfare, meals not specified, gratuities, personal expenses).
  2. Booking, Payment, and Pricing
    • 2.1. Booking: A booking is confirmed only upon our receipt of full payment and your acceptance of this Agreement.
    • 2.2. Payment: Full payment is required at the time of booking through our website’s payment portal or other authorized method.
    • 3.3. Pricing: All prices are quoted in Canadian Dollars (CAD) and are subject to all applicable federal and provincial taxes (e.g., HST). We reserve the right to modify prices without notice, but your price is guaranteed once you have paid in full.
  1. Cancellation and Modification Policy
    • 3.1. Cancellation by You: You may cancel your Tour by providing written notice to us. The following cancellation fees apply:
      • Notice received 30 days or more prior to the Tour date: Full Refund, less a $50.00 CAD administrative fee per person.
      • Notice received between 15 and 29 days prior to the Tour date: 50% of the total booking cost will be forfeited.
      • Notice received 14 days or less prior to the Tour date: 100% of the total booking cost will be forfeited.
    • 2. Cancellation or Modification by Us: Savant Tours reserves the right to cancel, alter, or reschedule any Tour at any time for any reason, including but not limited to, insufficient demand, safety concerns, or force majeure events. If we cancel a tour, we will offer you the choice of a full refund or rebooking on a future Tour of equivalent value. We will not be liable for any other costs, damages, or expenses you have incurred (e.g., non-refundable flights).
  1. Customer Code of Conduct
    You agree to conduct yourself in a manner that is respectful of your fellow participants and your guide. You must comply with all local laws and follow the instructions of the tour guide. Savant Tours reserves the absolute right to terminate your participation in the Tour, on the spot and without any refund, if your behavior is deemed to be illegal, disruptive, threatening, or to pose a risk to the safety or well-being of yourself or others.

It is your own responsibility to be punctual and on time for all Tour related activities, including departure or arrival or pick-up times. Savant Tours Inc. shall not be responsible or liable for any actions or inactions, in whole or in part due to your own tardiness, delay or lateness and has the right to operate the tour, including leaving and/or staying on schedule with or without your presence, as set out or as required. The timeliness and safety of the tour shall take precedence over individual needs or time related events caused by you.

  1. Assumption of Risk and Release of Liability
    • 5.1. Acknowledgment of Risk: You acknowledge that participation in the Tour involves inherent and unavoidable risks, including but not limited to, the risks associated with: travel by vehicle; physical exertion on walking and biking tours; consumption of alcohol on winery tours; uneven terrain; consumption of food or exposure to allergens and communicable diseases; actions of other people; and other risks of adventure travel.
    • 5.2. Release and Waiver: In consideration for being permitted to participate in the Tour, you, for yourself and on behalf of your heirs, assigns, and personal representatives, hereby fully and unconditionally RELEASE, WAIVE, AND DISCHARGE Savant Tours, its directors, officers, employees, agents, and affiliates from any and all liability, claims, demands, actions, and causes of action whatsoever, arising out of or related to any loss, damage, or injury, including death, that may be sustained by you, or to any property belonging to you, whatsoever, WHETHER CAUSED BY THE NEGLIGENCE OF SAVANT TOURS OR OTHERWISE, while engaging or participating in the Tour or any related Tour elements or services, or while in, on or upon the premises where the Tour is being conducted.
  1. Responsibility for Personal Belongings
    You are solely and exclusively responsible for your personal property and belongings at all times. Savant Tours shall not be held liable for the loss, theft, or damage of any personal items, luggage, cameras, electronics, or other property whatsoever during the Tour.
  2. Medical Fitness and Authorization
    You certify that you are in good health and medically fit to participate in the physical activities required by the Tour. You agree to inform us of any medical conditions or dietary restrictions in writing at the time of booking. You authorize Savant Tours and its representatives to secure emergency medical treatment on your behalf should it become necessary, and you agree to assume all financial responsibility for such care.
  3. Participants Under 18
    Any Customer under the age of 18 must be accompanied by a parent or legal guardian who accepts this Agreement on their behalf. The parent or legal guardian is fully responsible for the minor’s conduct and safety at all times under all circumstances.
  4. Use of Likeness
    You grant Savant Tours a worldwide, royalty-free, perpetual license to use any photographs, images, or videos in which you may appear, taken during the Tour, for any promotional, marketing, or commercial purposes, without any compensation to you. You may opt out by providing written notice prior to the Tour start date.
  5. Limitation of Liability

To the maximum extent permitted by applicable law, savant tours inc., its affiliates, and their respective directors, officers, employees, contractors, agents, guides, and representatives (collectively, the “Service Provider Parties”) shall not be liable for any loss, damage, cost, expense, injury, delay, inconvenience, or claim of any nature whatsoever, whether arising in contract, tort (including negligence), strict liability, statute, equity, or otherwise, relating to or arising out of:

(a) the provision, performance, non performance, or arrangement of any tour, activity, service, accommodation, transportation, or related services;

(b) any act, omission, or conduct of any third party, including without limitation transportation providers, accommodation providers, attractions, vendors, or other service providers;

(c) any personal injury, illness, death, property damage, loss, theft, or damage of any kind sustained by a participant or any third party; or

(d) any event, circumstance, or cause beyond the reasonable control of savant tours, including without limitation acts of God, weather conditions, natural disasters, epidemics or pandemics, strikes, labour disputes, government actions, delays, mechanical failures, civil unrest, or force majeure events.

Liability Cap:

To the extent that liability cannot be excluded under applicable law, the total aggregate liability of the Service Provider Parties, whether arising out of contract, tort (including negligence), strict liability, statute, or otherwise, shall in no event exceed the lesser of:

(i) the total amount actually paid by the client to savant tours for the specific tour or service giving rise to the claim; or

(ii) $500.00 CAD;

and such amount shall constitute the full and exclusive financial liability of the Service Provider Parties for all claims arising from or relating to the tour or service.

Assumption of Risk:

The client acknowledges that tours and related activities may involve inherent risks, including without limitation physical exertion, varying terrain, weather conditions, transportation risks, and interaction with third parties, and voluntarily assumes all such risks. savant tours shall have no responsibility or liability for any injury, loss, or damage resulting from such inherent risks.

Time Limitation on Claims:

Any claim or cause of action arising out of or relating to any tour or service must be commenced within six (6) months from the date the claim arose, failing which such claim shall be forever barred.

IN NO EVENT SHALL SAVANT TOURS, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF, OR IN ANY WAY CONNECTED WITH, YOUR ACCESS TO, DISPLAY OF OR USE OF THIS SITE, OR WITH THE DELAY OR INABILITY TO ACCESS, DISPLAY OR USE THIS SITE, WHETHER BASED ON A THEORY OF NEGLIGENCE, CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, AND EVEN IF SAVANT TOURS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  1. General Provisions
    • 11.1. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. The parties hereby attorn to the exclusive jurisdiction of the courts of Ontario located in Toronto.
    • 11.2. Entire Agreement: This Agreement, along with any applicable waivers and website policies, constitutes the entire agreement between you and Savant Tours and supersedes all prior agreements.
    • 11.3. Severability: If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
    • 11.4. Assignment: You not assign this Agreement without the prior written consent of Savant Tours.
    • 11.5. Force Majeure: We shall not be liable for any failure or delay in performance of our obligations which is caused by circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemic, or government restrictions.

ADDENDUM TO CUSTOMER TERMS OF SERVICE: TRANSPORTATION WAIVER, RELEASE, AND ASSUMPTION OF RISK

This Addendum forms an integral part of the Customer Terms of Service Agreement between you (“Customer”) and Savant Tours Inc. (“Savant Tours”). Your signature or electronic acceptance is required for participation in any Tour involving transportation arranged by Savant Tours.

  1. ACKNOWLEDGEMENT OF THIRD-PARTY PROVIDER
    Customer acknowledges that Savant Tours arranges for transportation services with independent third-party contractors and does not own, operate, or control these transportation vehicles. These providers are solely responsible for all aspects of the transportation services.
  2. ASSUMPTION OF INHERENT RISKS
    Customer understands and acknowledges that travel via bus or other vehicle involves inherent risks which may result in property damage, personal injury, or death. These risks include, but are not limited to: vehicular accidents; mechanical failure; injury from sudden stops or movement; and negligence of other drivers or the transportation provider. Customer knowingly and voluntarily assumes all such risks, both known and unknown.
  3. WAIVER AND RELEASE OF LIABILITY
    In consideration of being permitted to participate in transportation arranged by Savant Tours, Customer, for themselves and their heirs, assigns, and personal representatives, hereby RELEASES, WAIVES, AND FOREVER DISCHARGES Savant Tours Inc., its directors, officers, employees, and agents from any and all liability, claims, demands, or causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by Customer in connection with the transportation services provided, REGARDLESS OF WHETHER SUCH LOSS IS CAUSED BY THE NEGLIGENCE OF SAVANT TOURS OR ANY OTHER PARTY or while engaging or participating in the Tour or any related Tour elements or services.
  4. BUS SAFETY PROTOCOL
    Customer agrees to abide by all safety rules and instructions provided by the tour guide and the driver, including remaining seated while the vehicle is in motion and following emergency procedures.
