Welcome to the Savant Tours Inc. (“Savant Tours”, “we”, “us”, “our”) website, located at www.savant-tours.com (the “Site”). These Terms of Use (the “Terms”) govern your access to and use of the Site, including all content, information, and services provided through the Site.

By accessing or using the Site, you signify your agreement to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Site.

1.  USE OF THE SITE

• 1. License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use to gather information about our services and make legitimate bookings.
• 2. Eligibility: You must be at least 18 years of age and have the legal capacity to enter into binding contracts to use this Site to make a booking or have all required consents or authorizations from a parent or guardian as applicable, and are in compliance with any applicable merchant or platform rules or policies, including any credit card or payment related rules or regulations.

2.  INTELLECTUAL PROPERTY RIGHTS

All content on this Site, including but not limited to text, data, graphics, logos, button icons, images, audio clips, video clips, links, digital downloads, data compilations, and software (the “Content”), is the property of Savant Tours or its content suppliers and is protected by Canadian and international copyright, trademark, and other intellectual property laws. The compilation of all Content on this Site is the exclusive property of Savant Tours.

3.  PROHIBITED ACTIVITIES

You are prohibited from using this Site or its Content for any purpose that is unlawful or prohibited by these Terms, you agree not to engage in following type of action, conduct or behaviour set out below which shall include but not be limited to:

• (a) Use any robot, spider, scraper, or other automated means to access this Site for any purpose without our express written permission.
• (b) Take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionately large load on our infrastructure.
• (c) “Frame”, “mirror” or otherwise incorporate any part of this Site into any other website without our prior written authorization.
• (d) Attempt to modify, translate, adapt, edit, decompile, disassemble, or reverse engineer any software programs used by us in connection with the Site.
• (e) Post or transmit any unlawful, threatening, libelous, defamatory, obscene, pornographic or profane material or any material that could constitute or encourage conduct that would be considered a criminal offense or give rise to civil liability.

maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5.  DISCLAIMER OF WARRANTIES

SAVANT TOURS PROVIDES THIS SITE AND ITS CONTENT ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THIS SITE OR THE INFORMATION, CONTENT, MATERIALS, OR PRODUCTS INCLUDED ON THIS SITE. TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THIS SITE, ITS SERVERS, OR E-MAIL SENT FROM US ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

6.  LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, savant tours inc., its affiliates, and their respective directors, officers, employees, contractors, agents, guides, and representatives (collectively, the “Service Provider Parties”) shall not be liable for any loss, damage, cost, expense, injury, delay, inconvenience, or claim of any nature whatsoever, whether arising in contract, tort (including negligence), strict liability, statute, equity, or otherwise, relating to or arising out of:

• the provision, performance, non performance, or arrangement of any tour, activity, service, accommodation, transportation, or related services;
• any act, omission, or conduct of any third party, including without limitation transportation providers, accommodation providers, attractions, vendors, or other service providers;
• any personal injury, illness, death, property damage, loss, theft, or damage of any kind sustained by a participant or any third party; or
• any event, circumstance, or cause beyond the reasonable control of savant tours, including without limitation acts of God, weather conditions, natural disasters, epidemics or pandemics, strikes, labour disputes, government actions, delays, mechanical failures, civil unrest, or force majeure events.

Liability Cap:

To the extent that liability cannot be excluded under applicable law, the total aggregate liability of the Service Provider Parties, whether arising out of contract, tort (including negligence), strict liability, statute, or otherwise, shall in no event exceed the lesser of:

• the total amount actually paid by the client to savant tours for the specific tour or service giving rise to the claim; or
• $500.00 CAD;

and such amount shall constitute the full and exclusive financial liability of the Service Provider Parties for all claims arising from or relating to the tour or service.

Assumption of Risk:

The client acknowledges that tours and related activities may involve inherent risks, including without limitation physical exertion, varying terrain, weather conditions, transportation risks, and interaction with third parties, and voluntarily assumes all such risks. savant tours shall have no responsibility or liability for any injury, loss, or damage resulting from such inherent risks.

Time Limitation on Claims:

Any claim or cause of action arising out of or relating to any tour or service must be commenced within six (6) months from the date the claim arose, failing which such claim shall be forever barred.

IN NO EVENT SHALL SAVANT TOURS, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF, OR IN ANY WAY CONNECTED WITH, YOUR ACCESS TO, DISPLAY OF OR USE OF THIS SITE, OR WITH THE DELAY OR INABILITY TO ACCESS, DISPLAY OR USE THIS SITE, WHETHER BASED ON A THEORY OF NEGLIGENCE, CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, AND EVEN IF SAVANT TOURS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7.  INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Savant Tours and its affiliates, and their respective officers, directors, employees and agents, from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of: (a) your breach of these Terms; (b) your violation of any law or the rights of a third party; or (c) your use of this Site.

8.  THIRD-PARTY LINKS

This Site may contain hyperlinks to websites operated by parties other than Savant Tours. Such hyperlinks are provided for your reference only. We do not control such websites and are not responsible for their contents or the privacy or other practices of such websites.

9.  MODIFICATIONS

Savant Tours reserves the right to modify these Terms at any time without prior notice. Your continued use of the Site following the posting of changes will mean that you accept and agree to the changes.

10.  GENERAL PROVISIONS

• 1. Governing Law & Jurisdiction: These Terms shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. You hereby irrevocably consent to the exclusive jurisdiction of the courts of the Province of Ontario in the city of Toronto for any and all disputes arising out of or relating to the use of this Site.
• 2. Entire Agreement: These Terms, together with the Privacy Policy and Customer Terms of Service, constitute the entire agreement between you and Savant Tours regarding the Site.

• 3. Severability: If any part of these Terms is determined to be invalid or unenforceable, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the Terms shall continue in effect.
